Simple burglary is the unauthorized entering of any dwelling, vehicle, watercraft, or other structure, movable or immovable, or any cemetery, with the intent to commit a felony or any theft therein. The statute can be found at Louisiana Revised Statute 14:62.
It is worth noting that a theft does not have to occur for the offense to be considered a Simple Burglary. The individual only needs the intent to commit a felony or any theft.
If the offense involves entering an Inhabited Dwelling the law can be found under Louisiana Revised Statutes 14:62.3. It is defined as the unauthorized entry of any inhabited dwelling, house, apartment or other structure used in whole or in part as a home or place of abode by a person or persons with the intent to commit a felony or any theft therein.
Penalty
Whoever commits the crime of simple burglary of an inhabited dwelling shall be imprisoned at hard labor for not less than 1 year now more than 12 years , without benefit of parole, probation or suspension of sentence.
Penalties
Whoever commits this crime shall be fined not more than two $2,000, imprisoned with or without hard labor for not more than 12 Years, or both. It is possible to receive probation for this offense.
Whoever commits the crime of Simple Burglary of an Inhabited Dwelling shall be imprisoned imprisoned at hard labor for not less than 1 to 12 years.
